"We are contacting you on behalf of CoStar Group, for whom we manage internet monitoring and brand identity issues on the internet.
We are writing to inform you of a trademark violation on a website serviced by you concerning our client's brand CoStar Group.
The owner of this site is deliberately infringing on our client's intellectual property rights and trying to cause customer confusion by using CoStar Group trademarks without authorization and suggesting an association where one does not exist. This action constitutes trademark infringement and unfair competition. We are therefore asking for your assistance in having the site owner remove any and all of the above references from the URL below:

We truly appreciate your co-operation in this matter and hope to hear from you at your earliest convenience."

Why This Abuse Report Is Without Merit
- No Phishing: This site does not collect credentials, solicit financial information, impersonate login portals, or deceptive web forms.
- No Trademark Infringement: Usage of names is strictly nominative fair use necessary to identify the subject of discussion.
- No Use of Logos or Assets: No proprietary logos, copyrighted imagery, trade dress, or assets belonging to CoStar or Homes.com are used.
- No Consumer Confusion: Under 15 U.S.C. § 1114(1)(a) and § 1125(a)(1)(A), there is zero likelihood of confusion regarding source, sponsorship, or affiliation due to explicit disclaimers and the complete absence of corporate branding.
- No "Use in Commerce": Under 15 U.S.C. § 1114(1)(a) and § 1125(a)(1), a plaintiff must establish a threshold "use in commerce... in connection with the sale, offering for sale, distribution, or advertising of any goods or services" (see Bosley Medical Institute, Inc. v. Kremer, 403 F.3d 672, 676 (9th Cir. 2005)). This site generates zero revenue, contains no advertisements, sells no services, and operates purely for non-commercial speech.
- No Bad Faith Intent: The content exists solely to inform the public on privacy rights and PII removal procedures.
- No DMCA Copyright Violation: All text on this page is original commentary and educational instruction. No copyrighted text or code has been copied.
- No Domain Name Violation: This site uses a free provider subdomain string, not a registered apex domain bought for resale, squatting, or commercial redirection.
- First Amendment Protection: Non-commercial commentary, consumer education, and public critique are fully protected expression under the First Amendment of the U.S. Constitution.
Legal Precedent
Courts have consistently held that non-commercial gripe, commentary, and educational sites using trademarked terms do not violate trademark law or constitute commercial confusion:
Taubman Co. v. Webfeats (6th Cir. 2003)
Held that non-commercial gripe sites using trademarked names do not cause trademark infringement under the Lanham Act because there is no commercial use.
Bosley Medical Institute, Inc. v. Kremer (9th Cir. 2005)
Reaffirmed that non-commercial use of a trademark in a domain name for commentary or criticism does not violate the Lanham Act or the Anticybersquatting Consumer Protection Act (ACPA).
Wal-Mart Stores, Inc. v. wallmartcanadasucks.com (WIPO D2000-0477)
Established long-standing precedent that non-commercial consumer criticism using brand names in domain strings does not constitute bad-faith commercial exploitation.
Response to "Hope to Hear From You"
"We truly appreciate your co-operation in this matter and hope to hear from you at your earliest convenience."
However, the reporter provided no name, no email address, no phone number, and no verifiable contact information. The report was submitted as "Anonymous."
We cannot respond to a party that refuses to identify themselves. If CoStar Group or their legal representatives wish to engage in good-faith dialogue, they are welcome to contact us directly with verifiable credentials. Until then, this anonymous complaint appears to be an attempt to suppress legitimate consumer speech without accountability.
